TERMS AND CONDITIONS FOR ONLINE SALES

These terms and conditions apply to all online sales of products by Tibrock Pty Ltd (ACN 124 856 962) as trustee for the ROGER ARMSTRONG UNIT TRUST trading as Roger Armstrong of 31/328 Reserve Road, Cheltenham, VIC 3192 ("Roger Armstrong", "we", "our" or "us") to consumers (“you”). You accept these terms and conditions by submitting an order to purchase products from this website.

RETURNS AND REFUND POLICY

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

As well as the rights you have under the Australian Consumer Law, our Returns and Refunds Policy provides you with additional benefits.

PROCESS FOR RETURNS

Please contact our Customer Service Team, during business hours (AEST), on (03) 9584 2066 or on websales@rogerarmstrong.com.au before returning any goods.

An official Roger Armstrong Return Authorisation (RA) number is required for all returns, replacement products and refunds. Where a member of our Customer Service team has provisionally determined that a product is defective or a return is warranted, Customer Service will issue you with an RA. Products cannot be returned without an RA. The Product should be returned to Roger Armstrong within 14 calendar days of the RA being issued.

Refunds will only be offered via the original payment method, including credit cards and specifically the original card.

DEFECTS

If your purchase is in any way faulty, not fit for the purpose intended or does not match the description, we will reimburse you for the costs of returning the product to us and arrange for the product to be repaired or replaced, or you can elect to have your money refunded. This will be refused if the product is determined to have been damaged due to inappropriate use.

CHANGE OF MIND

If, for any reason, you are not totally satisfied with your purchase, you may return your items unused, in original unmarked packaging within 14 days of purchase for replacement or refund of the purchase price (excluding delivery charges). Risk of loss or damage to the goods will not be assumed by us until the item has been received at our warehouse.

Roger Armstrong reserves the right to charge additional postage and handling charges for product exchanges that are not the result of product defect or our cause.

Unless the product is defective, no refunds or exchanges will be offered for products:

All Products must be suitably packed in the original, unmarked packaging including all accessories that were originally shipped with the Product. Any missing items will affect the refund amount.

Roger Armstrong reserves the right to charge additional postage and handling charges for product exchanges that are not the result of product defect or our cause.

No refunds or exchanges will be offered for products that have be worn or washed.

No refunds or exchanges will be offered on products or any garments where the packaging has been damaged.

Refunds will only be offered via the original payment method, including credit cards and specifically the original card.

PRIVACY POLICY

This privacy policy refers to the storage and usage of data you provide whilst using our website. Roger Armstrong is completely committed to ensuring that your privacy is protected.

Any information we collect in relation to you is kept strictly secure. We do not pass on, sell or swap any of your personal details with any person or company. We use this information to identify your orders and to personalise your shopping experience with us.

Please note, we will record your email address if you send us an email. We reserve the right to include your email address as part of our email communications to which you can unsubscribe if you choose.

Cookies allow us to provide you with a more personalised shopping experience and provide you with a better website by displaying products that you have shown interest in on our product pages.

When you place an order, you agree that we may store, process and use data collected from your orders for the purposes of processing and delivering your Order.

You may obtain a copy of the data held by us concerning you by submitting a request in writing. We reserve the right to charge an administration fee for processing such a request. If you have any concerns or any data held by us concerning you is incorrect, we will correct it upon receiving your written request. We are committed to ensuring that your information is secure. To help prevent unauthorised access to any data, we have put in place suitable procedures to safeguard your information.

When purchasing from Roger Armstrong, your financial details are passed through a secure server using the latest 128-bit SSL (secure socket layer) encryption technology. 128-bit SSL encryption is the current industry standard. SHIPPING & DELIVERY POLICY

Roger Armstrong uses Australia Post and other Independent carriers to deliver products Australia wide. For bulky goods such as furniture, strollers and other bigger items, please email us at sales@rogerarmstrong.com.au as we will quote a delivery charge at time of order and a staff member will contact you to discuss the additional charges.

Orders are dispatched within 5 business days. Shipping times are estimated at between 4-7 business days depending on your location within Australia. Please note that we are unable to guarantee delivery of your order by or within a certain time, and no damages or compensation will be payable in the event of delayed delivery.

All transactions are processed in Australian Dollars (AUD).

Disclaimer and limitation of liability

You acknowledge that you purchase products from Roger Armstrong at your own risk. Except as provided by law, the products purchased from us are provided "as is" and without any warranty or representation, express or implied. To the maximum extent permitted by law, we exclude all implied representations and warranties which, but for these terms and conditions, might apply in relation to products purchased from us. Where liability cannot be excluded, any liability incurred by Roger Armstrong is limited as provided under the section 64A of the Australian Consumer Law.

We are not responsible for:

•               loss that was not reasonably foreseeable;

•               loss that was not caused by our breach of contract or by our negligence;

•               indirect or secondary loss that arises from any breach by us;

•               losses that relate to a business, such as lost data, lost profits or business interruption, that you or a third person is engaged in;

•               any increase in loss that was caused by your breach of contract or your negligence.

You must take all reasonable steps to minimise the extent of any loss you may suffer as a result of your use of any products purchased from us.

Governing Law, Location and Miscellaneous

These Terms and Conditions of Sale shall be governed in all respects by the laws of the State of Victoria, Australia, without reference to its choice of law rules. If an applicable law is in conflict with any part of the Terms and Conditions of Sale, the Terms and Conditions of Sale will be deemed modified to conform to the law. The other provisions will not be affected by any such modification. You agree to submit to the exclusive jurisdiction of the courts of State of Victoria, Australia.

If any part of the Terms and Conditions of Sale is invalid or unenforceable, that part will be struck out and the remaining terms will remain in force.
